State Sen. Sabrina Cervantes, D-Riverside, will not be prosecuted for driving under the influence following a May 19 traffic collision in Sacramento, the Sacramento County district attorney’s office announced Friday, May 30.
In an emailed statement, the office said a blood sample taken from Cervantes the day of the accident was “negative for any measurable amount of alcohol or drugs.”

“We have reviewed (all of) the submitted evidence, including police reports, witness statements, and laboratory results,” the statement read.
“Based on our ethical duty and the burden of proof in a criminal trial, the Sacramento County DA’s Office declines to file any charges in this case.”
Cervantes, who represents parts of Riverside and San Bernardino counties, insisted there were no drugs or alcohol in her system following the two-vehicle collision near the state Capitol.
Sacramento police cited the 37-year-old on suspicion of driving under the influence of a drug after visiting her in the hospital, where she was treated for minor injuries. Officers “observed objective signs of intoxication” in Cervantes during the visit, a Sacramento police spokesperson has said.
Cervantes has said she was “accosted by Sacramento Police Department officers, falsely accused of driving under the influence, and involuntarily detained for several hours at the hospital.”
